  • Client: Refers to individuals or entities engaging Midas Real Estate for real estate services (e.g., buying, selling, renting, property management).
  • Commission/Fee: Refers to the payment due to Midas Real Estate for services rendered, as agreed upon in separate service agreements.

  • ⁠Will & Court Services

3. User Obligations

By using our Service, you agree to:

  • Provide accurate, current, and complete information when required (e.g., during registration, inquiry submissions).
  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Not to engage in any activity that could damage, disable, overburden, or impair the Service or interfere with any other party’s use of the Service.
  • Not to upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Not to attempt to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service or to any Midas Real Estate server.
  • Maintain the confidentiality of any account credentials you may have.

4. Property Listings and Information

  • Accuracy: While Midas Real Estate strives to ensure the accuracy of all property listings and information provided, we do not guarantee the completeness, reliability, or accuracy of any information. Property details, prices, availability, and specifications are subject to change without prior notice.
  • Verification: Users are solely responsible for verifying the accuracy of any information obtained through the Service before making any decisions or entering into any agreements. Midas Real Estate recommends independent verification and professional advice.
  • Third-Party Content: The Service may contain links to third-party websites or services that are not owned or controlled by Midas Real Estate. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

5. Fees and Commissions

  • Midas Real Estate operates on a commission and/or fee basis for its services.
  • Specific commission rates, fees, and payment terms will be clearly outlined in separate, legally binding service agreements, mandates, or contracts entered into between Midas Real Estate and its Clients.
  • By engaging Midas Real Estate’s services, Clients agree to the payment terms stipulated in such agreements.
  • All payments shall be made in AED (United Arab Emirates Dirham) unless otherwise agreed upon in writing.
  • Late payment penalties may apply as per individual agreements.

6. Confidentiality

  • Midas Real Estate will treat all client information with confidentiality and will not disclose it to third parties without prior consent, except as required by law or for the purpose of providing the agreed-upon services (e.g., sharing details with prospective buyers/tenants).
  • Users agree to maintain the confidentiality of any proprietary or sensitive information disclosed to them by Midas Real Estate or other users through the Service.

7. Intellectual Property

  • The Service and its original content, features, and functionality are and will remain the exclusive property of Midas Real Estate and its licensors.
  • The Service is protected by copyright, trademark, and other laws of both the United Arab Emirates and foreign countries.
  • Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Midas Real Estate.

8. Disclaimer of Warranties

  • The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Midas Real Estate makes no representations or warranties of any kind, express or implied, as to the operation of their Service or the information, content, materials, or products included on their Service.
  • Midas Real Estate does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

9. Limitation of Liability

  • In no event shall Midas Real Estate, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
    • Your access to or use of or inability to access or use the Service;
    • Any conduct or content of any third party on the Service;
    • Any content obtained from the Service; and
    • Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Indemnification

You agree to defend, indemnify, and hold harmless Midas Real Estate and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the Service.

11. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates as applied in Dubai.

Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by the Courts of Dubai.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Changes to Terms & Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
